STOFILE CHATS TO AM LIVE

In an interview with AM Live host, John Pearlman, today, Eastern Cape Premier, Rev Makhenkesi Stofile, restated that he knew of the Dr 
Bevan Goqwanas ambulance service business prior to his appointment as an MEC.

Rev Stofile said Section 22 of the Constitution gave MEC, Dr Bevan Goqwana, the right to choose a trade, career or anything that interested 
him. But in that section of the constitution, the last sentence also says the trade rights can be regulated by law and in this county the 
law that regulates that one is the Code of Conduct, there is no other one, he said.

Rev Stofile said that the Eastern Cape Code of Conduct of 1998 was the only such law that applied to the MECs in the province and it says 
that in the event of MECs having business interests they must declare them to the Premier.

He added that there was also section 136  2B of the Constitution that indirectly linked to the Dr Goqwana case even though it related to 
other business.If for instance a lawyer is an MEC, he cannot practice as a lawyer and if a doctor is an MEC he cannot practice as a 
doctor, he said.

Section 2B of 136 according to Rev Stofile says that MECs should refrain from participating in activities that might compromise or conflict 
with their official responsibilities. Now cognisant of that I had advised the MEC, because he is new, only started in June last year, of 
his constitutional right and advised him to forfeit it because owning that kind of business because it is directly related to his work and 
he agreed.

This happened in August last year. The Premier said the MEC has had difficulty with selling his business and had to take it back from the 
original consortium that bought it to find another buyer.

Now that is where the situation stands.
